2024 ALTO VELO RACING CLUB ACKNOWLEDGEMENT OF RISKS -- WAIVER AND RELEASE OF LIABILITY

In consideration of being allowed to participate in any way in the Alto Velo Racing Club, a California Non-Profit Public Benefit Corporation (“Alto Velo”) program, its related events and activities (collectively, the "Alto Velo Programs"),

I acknowledge, appreciate, and agree that:

  1. The risk of injury from participating in the activities involved in the Alto Velo Programs is significant, including the potential for permanent paralysis and death, and while particular skills, equipment, and personal discipline may reduce this risk, the risk of serious injury does exist; and,

  2. I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, both known and unknown, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASEES or others, and assume full responsibility for my participation; and,

  3. I willingly agree to comply with the stated and customary terms and conditions for participation. If, however, I observe any unusual significant hazard during my presence or participation in the Alto Velo Programs, I will remove myself from participation and bring such significant hazards to the attention of a representative of Alto Velo immediately; and,

  4. I, for myself and on behalf of my heirs, assigns, personal representatives and next of kin, HEREBY RELEASE, FOREVER DISCHARGE, INDEMNIFY, AND HOLD HARMLESS Alto Velo and USA Cycling, Inc., their officers, members of their respective boards of directors, officials, agents, members, representatives and/or employees, other participants in the Alto Velo Programs, sponsoring agencies, sponsors, advertisers, and, if applicable, owners and lessors of premises used for the Alto Velo Programs ("Releasees"), WITH RESPECT TO ANY AND ALL INJURY, DISABILITY, DEATH, or loss or damage to person or property associated with my presence or participation in the Alto Velo Programs, WHETHER ARISING FROM THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE, to the fullest extent permitted by law.

  5. I grant Alto Velo and its successors and assigns, the unrestricted, royalty-free, and perpetual right and permission to copyright and use, re-use, publish, and republish Alto Velo related photographic and digital images of me or in which I may be included for any purpose, including promotions, advertising, trade or other purposes, and I grant Alto Velo the right to assign such right to sponsors and others at its sole discretion.

I AM 18 YEARS OF AGE OR OLDER AND HAVE READ THIS WAIVER AND RELEASE OF LIABILITY. I FULLY UNDERSTAND ITS TERMS, I UNDERSTAND THAT I WILL GIVE UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND I SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.
